The Federal Trade Commission (FTC) is reviewing its rules and guidance documents on the Magnuson-Moss Warranty Act, a 1975 federal law that governs consumer product warranties. SEMA submitted several recommendations on how the rules can be expanded to clarify manufacturer responsibilities and consumer protections.

Last December, the FTC issued a Consumer Alert, which confirms that it is illegal to void a warranty or deny coverage based on the mere presence of an aftermarket part. The alert notes that a consumer has the right to patronize independent retail stores and repair shops for parts and service without fear of voiding the new-car warranty. The dealer/vehicle manufacturer has the right to deny a warranty repair if they can demonstrate that the aftermarket part caused the problem. The warranty remains in effect for all other covered parts.

In its comments to the FTC, SEMA recommended that the agency issue a supplemental alert to specifically reference installation of specialty parts. While the Magnuson-Moss Warranty Act covers these types of consumer products, the December alert generally described straight repair/maintenance issues. SEMA also recommended that the FTC’s definition of “consumer product” be clarified to include specialty parts.

SEMA recommended that auto dealerships be required to put in writing why a warranty is being denied. While the law requires that consumer warranties be written in a single, clear and easy-to-read document, there is no corresponding requirement for warranty denials. Under the law, it is the dealership’s obligation to diagnose a problem and demonstrate that the aftermarket part caused the damage or defect. For dealerships that may not be aware of this requirement or may seek to avoid the obligation, a directive from the FTC would be an educational resource.

Documenting the alleged cause of a problem and providing a copy of test results or other evidence upon which the dealership is basing its claim creates a level playing field for the consumer. It may ultimately assist in resolving a dispute by allowing the claim to be properly considered by the consumer and potentially a third-party mechanic, the aftermarket manufacturer or a mediator.

SAN Website
To make it easier than ever for SAN members to find the information they need to help protect their passion, SAN has streamlined its website.

In 1997, the SEMA Action Network (SAN) was created with the goal of protecting every niche of the automotive hobby against unfair laws and regulations. Since its inception, SAN has seen the coming of a new digital era in which SAN members rely heavily on e-mail, social networking and the World Wide Web to access information. To keep pace with these changes, SAN has streamlined its website, www.semasan.com, to make it easier than ever for SAN members to find the information they need to help protect their passion.

SAN is a nationwide partnership between enthusiasts, vehicle clubs and members of the automotive specialty-parts industry who have joined forces to promote hobby-friendly legislation and oppose unfair laws. With more than 60,000 North American members, SAN is the premier organization defending the rights of vehicle enthusiasts. SAN is free to join with no obligations or commitments.

“No other organization brings such a comprehensive set of tools and resources directly to hobbyists' computers,” said SEMA Vice President of Government Affairs Steve McDonald. “Our intent with the new website design was to make these resources more easily accessible to the thousands of vehicle enthusiasts who rely on the SEMA Action Network daily for updates on threats and opportunities facing the hobby.”

Resources featured on the streamlined www.semasan.com include:
  • Up-to-the-minute action alerts with bill information, speaking points and legislator contact information.
  • Archived breaking news items for a comprehensive overview of SAN efforts.
  • Digital copies of the SAN’s award-winning monthly legislative newsletter, Driving Force
  • State-by-state tracked legislation.
  • Guidance on federal and state issues, including land use, warranty denial, emissions inspections, ethanol, scrappage and much more.
  • “Tag & Title Toolbox”—a one-stop shop for state resources listing each state’s specialty-vehicle definitions, registration and titling provisions, forms, inspection criteria and other requirements and exemptions.
  • Printable pro-hobby model legislation crafted by SAN staff.
  • Information on legislators who support the automotive hobby through the Congressional Automotive Performance and Motorsports Caucus and the State Automotive Enthusiast Leadership Caucus.
  • An automated tool for identifying and contacting your federal, state and local representatives.
  • A guide to lobbying your elected officials.
In its 15-year history, the effect of the SAN on shaping government policy has been enormous. Among many other things, the SAN has successfully enacted street-rod and custom vehicle (including kit cars and replicas) registration and titling laws in 22 states; protected classic vehicles waiting to be restored on private property from confiscation; defended enthusiasts' right to use more durable aftermarket exhaust systems; junked state-level “Cash for Clunkers” legislation; advocated to ensure public lands remain open to responsible off-road recreation and enacted legislation to lower taxes and fees for hobbyist vehicles.

The current economic and legislative environment is emboldening governments to become more aggressive with their anti-auto-hobby legislation. States are seeking new avenues for generating revenue and new ways of dictating what you can and cannot do with your vehicles. The message government is sending is clear—the hobby needs the SEMA Action Network now more than ever. Enlist now in this fellowship of auto enthusiasts—join the SAN at www.SEMASAN.com.

The third class covers vehicle graphics and detailing. Learn the subtle differences in detailing using the West Coast Customs brand of detail products, and the application process of vinyl graphics. Rounding out the classes is the Accessories, Wheel and Tire class. Students here will learn fitment tips, along with installation of Continental Tires on Asanti Rims. Students will also learn techniques to install suspensions before they mount the new wheels and tires.

All of the action will be filmed for an upcoming episode of the hit show "Inside West Coast Customs" on Velocity.

Exhibitors can have their new products packaged and shipped back to them by The UPS Store at the end of the Show.

Ideas Alive: Featuring the New Products Showcase is one of the biggest and most exciting draws of the SEMA Show, and this year will prove no different. Manufacturers will showcase more than 1,500 of their newest products and best ideas to some 55,000 buyers. But once the showcase is over, how will exhibitors get their new products back home?

This year, exhibitors can have their new products packaged and shipped back to them by The UPS Store at the end of the Show. Instead of returning to the New Products area themselves on the last day of the Show, exhibitors can arrange for The UPS Store to handle the packaging and shipping of their items for them.

“The New Products Showcase is one of the most exciting parts of the SEMA Show,” said Kristin DeBates, corporate marketing manager for the UPS Automotive Segment. “UPS wants exhibitors to enjoy the entire Show, and if we can do this by alleviating any worries around getting their exhibit items home from the New Products Showcase, we are happy to do so.”

New Products Showcase exhibitors must sign up for this service during New Products check-in, but they can stop by UPS booth #11827 or any of the three convenient The UPS Store locations in the North, South and Central Halls of the Las Vegas Convention Center if they have any questions throughout the week.
